Wireless
• CPE (Customer Premises Equipment) remains the property of the client ONLY if it was Purchased. Equipment does have a 1 year limited warranty, after that client will be responsible for maintenance on equipment.
• If Installation is purchased, 100% installation fee to be paid on day of installation. All services are prepaid and services are billed in advance.
Fibre
• CPE (Customer Premises Equipment) remains the property of Rapid Networks.
• Month to Month Agreement, 100% installation fee to be paid before installation. All services are prepaid and services are billed in advance.
• Fibre infrastructure: Rapid Networks is a fibre reseller and only delivers bandwidth to the client, fibre infrastructure is owned by the fibre provider (Openserve, Zoom, Vumatel, etc). All fibre related issues/damages will be subject to fibre provider repair turnaround times
Wireless & Fibre
• Broadband Services are not guaranteed and are supplied on a best effort basis.
• Rapid Networks assumes no responsibility and makes no representations with regard to the quality or reliability of data accessed or the inability to access data via Rapid Networks networks other than warranties in the form of uptime guarantees.
• The client agrees that it is solely responsible for the security and the maintenance of the security of any user details, including access codes and passwords.
• It is the responsibility of the client to notify Rapid Networks in the event of the client being unable to connect to the service.
• All service fees paid by Debit Order due by the selected date above.
• Suspension of Service: Client will be liable to all reconnection fees before service is reactivated and will be billed a pro rata rate after reactivation. Fibre Reactivation is subject to fibre provider turnaround time.
• The client agrees to Rapid Networks requesting a credit check prior to processing this contract. In the event of there being credit defaults Rapid Networks may at its discretion require installation and pro rata payment in advance.
• I agree to the Contention and Fair Usage Policy of my selected package.
• Cancellations may be done in writing by way of an email sent to accounts@rapidnetworks.co.za. A calendar months’ notice will apply.
• If paying by Debit Order, the first debit order will take place on whichever day you selected and the following month.
• Notwithstanding any other provision of this SLA the client and/or any other person/entity will not have any claim against Rapid Networks whatsoever arising for direct damages, indirect dames, loss of profits and incidental, special or consequential damages and the client hereby indemnifies and holds harmless Rapid Networks, its officers, employees, subsidiaries, affiliates and contractors in respect of such damage or loss.
• The client chooses domicilium citandi et executandi for the purpose of giving any notice, paying any sum, serving any process or for any other purpose arising from this agreement at the address provided to Rapid Networks when subscribing to this service and agrees that any notice sent in terms of this agreement may be sent via email.
• All prices listed in this SLA are inclusive of VAT and can be changed when VAT changes are needed.

Conversion from Other Wireless Internet Service Provider (WISP):
• Rapid Networks can not guarantee the following from previous WISP equipment:
1. Compatibility
2. Speed
3. Latency
4. Reliability
• If previous WISP equipment is not compatible in the area and if possible Rapid Networks will swap out previous WISP equipment with compatible equipment but take ownership of previous WISP equipment.
• If equipment was swapped there will be a limited 3 month warranty on the swapped equipment see purchased Installation Equipment section for more warranty details.
Rental Equipment:
• Rental is ongoing
• Equipment remains property of Rapid Networks
Purchased Equipment:
Rapid Networks (Pty) Ltd t/a Rapid Networks warrants it’s Client that the goods which have been supplied by it and delivered to the client shall be free from defects and subject to the following:
• The warranty is effective for a period of a year unless otherwise specified. The date is determined from date of delivery and will the Client be entitled to either request a refund; replacement or repair of the goods if the goods being provided are believed to be of a substandard quality within such period;
• The warranty shall immediately be rendered null and void in the event of any of the following:
1. Any alterations or modifications or addition made to the goods, without the prior consent of Rapid Networks (Pty Ltd t/a Rapid Networks;
2. Failure to use goods supplied in accordance with the instructions and specifications of Rapid Networks (Pty) LTD t/a Rapid Networks;
3. Damages due to the general mistreatment and abuse of the goods supplied;
4. Any damage caused by fire, flood, civil disturbance or act of God;
5. The goods have not been inspected by and technical expert in order to evaluate / determine the reason for the defects in the material, before the Client requested its replacement, repair or refund.
Whilst delivery times are given in good faith and Rapid Networks (Pty) Ltd t/a Rapid Networks will use every endeavour to comply therewith, no responsibility can be accepted for any loss or damage incurred by the Client on account of any delay in delivery arising out of any circumstances beyond Rapid Networks (Pty) Ltd t/a Rapid Networks’s control, which circumstances will include, but in no way be limited to:
• Any delays in the supply of goods/services by rapid Networks (Pty) Ltd t/a Rapid Networks which cannot be directly or indirectly attributed to them;
• The client not providing Rapid Networks (Pty) Ltd t/a rapid Networks with necessary information in order to determine the specifications of the goods required.
• The client or his/her/its employees not providing Rapid Networks (Pty) Ltd t/a rapid Networks with the adequate information, necessary in order to ensure that the goods meets its specific requirements. The Company reserve the right to amend the initial quotation, should the Client’s original requirements change or upon inspection by us;
• If the balance of the contract price payable on date of reservation is not paid on date of anticipated delivery to rapid Networks (Pty) Ltd t/a Rapid Networks.
Rapid Networks (Pty) Ltd t/a Rapid Networks will communicate unavoidable delay in the delivery.
Outstanding Invoices:
Rapid Networks (Pty) Ltd t/a Rapid Networks reserved their right to suspend delivery of any services in the event that payment for such services is not made on time. In the circumstances where payment is outstanding for a period exceeding 14 days from date of invoice due date Rapid Networks (Pty) Ltd t/a Rapid Networks will collect any rental equipment and terminate the service.
All accounts older than 30 days will be handed over for collection and the Client be liable to pay all legal fees with regard to the collection of such outstanding amounts on a fees scale as determined by the court of law/tribunal where the collection matter will be adjudicated.
The Client hereby agrees to the jurisdiction of the Magistrate Court of Vredenburg in the event that any outstanding amount is handed over for collection, although such Magistrate Court may normally not have jurisdiction in the matter.
NOTIFICATION TO THE DATA SUBJECT WHEN SUPPLYING PERSONAL INFORMATION
The data subject (client/consumer) must note that all the information supplied to the responsible party (Rapid Networks (Pty) Ltd t/a Rapid Networks; Windstone Farm, Vredenburg) will be recorded and processed regardless of form or medium in which the information was supplied.
Personal information is collected to enable Rapid Networks (Pty) Ltd t/a Rapid Networks to deliver a service to its clients/customers and for billing purposes (where applicable).
The personal information supplied is mandatory and if applicable is authorized or required by the Protection of Personal Information Act. The data subject has the right at any time to rectify the personal information collected, object to the processing of personal information (subject to legislation) and to lodge a complaint at the Information Regulator.
• I/We hereby acknowledge that the information provided is true and correct.
• I/We further proclaim that
• I/We shall in no way hinder the process of such said payments.
• I/We further confirm that I/We have read and understood the Rapid Networks terms and conditions of service as set out in the Rapid Networks Acceptable User Policy which can be found on the Rapid Networks Website, being subject to change from time to time.
• I/We realise that should I/We breach this agreement in any way, Rapid Networks are entitled to suspend my services and/or cancel this agreement with immediate effect.
